Filing Instructions - Resubmit a Rejected Filing

Resubmit a rejected filing

  1. Log in to the Secretary of State’s filing system
  2. Click the type of rule filing you need to resubmit (such as “Permanent rule filings”)
  3. Click “Resubmit a rejected filing”
  4. Enter the tracking number for the filing you need to resubmit, and press “Next”
  5. Proceed with the filing depending on the filing type, listed below

For notices of rulemaking:

  1. Scroll to the attachments section
  2. Click “Edit” to remove an existing file, then click “Choose a file” to upload a new file
  3. Click “Submit” to complete the resubmission
  4. Note: A new file must be uploaded before you can press “Submit”
  5. Save or print the confirmation page and keep it as proof of your filing. If a confirmation page does not appear, your filing was not completed. You can resubmit the filing, or email our office at rules@coloradosos.gov if you need help

For AG opinion requests:

  1. Scroll to the bottom of the page and click “Next”
  2. Attach updated version(s) of the clean copy of the adopted rules (if applicable) by pressing “Choose File”, choosing your file, and clicking “Upload”, then click “Next”
  3. For emergency rule filings only, attach updated version of the statement of justification document (if applicable) by pressing “Choose File”, choosing your file, and clicking “Upload”, then click “Next”
  4. Attach updated version of the statement of basis and purpose document (if applicable). If it is not included in the text of the adopted rules by pressing “Choose File”, choosing your file, and clicking “Upload”, then click “Next”
  5. Attach updated version of the regulatory analysis (if applicable and appropriate) by pressing “Choose File”, choosing your file, and clicking “Upload”, then click “Next”
  6. Attach updated redline version of your adopted rules (if applicable) by pressing “Choose File”, choosing your file, and clicking “Upload”, then click “Next”
  7. On the “Review and submit” page, check for accuracy. You may open attachments here and review
  8. Click “Submit” to file the resubmission
  9. Save or print the confirmation page and keep it as proof of your filing. If a confirmation page does not appear, your filing was not completed. You can resubmit the filing or email our office at rules@coloradosos.gov

Note: If an AG opinion has been issued before you have resubmitted your AG opinion request, then you must file a correction.

For a correction:

  1. Attach a file containing the corrected text
  2. Click "Submit"
  3. Save or print the confirmation page and keep it as proof of your filing. If a confirmation page does not appear, your filing was not completed. You can resubmit the filing or email our office at rules@coloradosos.gov if you need help

Ensure that you are resubmitting rejected documents at least five days before the Colorado Register publication so our office has enough time to review and process the resubmitted documents. Any resubmitted documents filed after those five days before the Colorado Register publication will be included in the next publication, if the resubmitted documents pass accessibility review.
